1. GENERAL PROVISIONS

1.1. Niniejsza polityka prywatności Sklepu Internetowego ma charakter informacyjny, co oznacza że nie jest ona źródłem obowiązków dla Usługobiorców lub Klientów Sklepu Internetowego. Polityka prywatności zawiera przede wszystkim zasady dotyczące przetwarzania danych osobowych przez Administratora w Sklepie Internetowym, w tym podstawy, cele i zakres przetwarzania danych osobowych oraz prawa osób, których dane dotyczą, a także informacje w zakresie stosowania w Sklepie Internetowym plików cookies oraz narzędzi analitycznych.

Administratorem danych osobowych zbieranych za pośrednictwem Sklepu Internetowego jest Urszula Rybak, prowadzącą działalność gospodarczą pod firmą: „Urszula Rybak”  z siedzibą w Warszawie 02-593, pod adresem:  Ul. Karola Chodkiewicza 7/99,  wpisaną do ewidencji działalności gospodarczej pod numerem 382967217, numer identyfikacyjny NIP 5213861898 [email protected] oraz numer telefonu kontaktowego: (+48) 608 514 614. zwana dalej„Administratorem” i będąca jednocześnie Usługodawcą Sklepu Internetowego i Sprzedawcą.

1.3. 
Dane osobowe w Sklepie Internetowym przetwarzane są przez Administratora zgodnie z obowiązującymi przepisami prawa, w szczególności zgodnie z rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) - zwane dalej „RODO” lub „Rozporządzenie RODO”. 1.4. 
Korzystanie ze Sklepu Internetowego, w tym dokonywanie zakupów jest dobrowolne. Podobnie związane z tym podanie danych osobowych przez korzystającego ze Sklepu Internetowego Usługobiorcę lub Klienta jest dobrowolne, z zastrzeżeniem dwóch wyjątków: (1) zawieranie umów z Administratorem - niepodanie w przypadkach i w zakresie wskazanym na stronie Sklepu Internetowego oraz w Regulaminie Sklepu Internetowego i niniejszej polityce prywatności danych osobowych niezbędnych do zawarcia i wykonania Umowy Sprzedaży lub umowy o świadczenie Usługi Elektronicznej z Administratorem skutkuje brakiem możliwości zawarcia tejże umowy. Podanie danych osobowych jest w takim wypadku wymogiem umownym i jeżeli osoba, które dane dotyczą chce zawrzeć daną umowę z Administratorem, to jest zobowiązana do podania wymaganych danych. Każdorazowo zakres danych wymaganych do zawarcia umowy wskazany jest uprzednio na stronie Sklepu Internetowego oraz w Regulaminie Sklepu Internetowego; (2) obowiązki ustawowe Administratora - podanie danych osobowych jest wymogiem ustawowym wynikającym z powszechnie obowiązujących przepisów prawa nakładających na Administratora obowiązek przetwarzania danych osobowych (np. przetwarzanie danych w celu prowadzenia ksiąg podatkowych lub rachunkowych) i brak ich podania uniemożliwi Administratorowi wykonanie tychże obowiązków.

Administrator dokłada szczególnej staranności w celu ochrony interesów osób, których przetwarzane przez niego dane osobowe dotyczą, a w szczególności jest odpowiedzialny i zapewnia, że zbierane przez niego dane są: (1) przetwarzane zgodnie z prawem; (2) zbierane dla oznaczonych, zgodnych z prawem celów i niepoddawane dalszemu przetwarzaniu niezgodnemu z tymi celami; (3)merytorycznie poprawne i adekwatne w stosunku do celów, w jakich są przetwarzane; (4) przechowywane w postaci umożliwiającej identyfikację osób, których dotyczą, nie dłużej niż jest to niezbędne do osiągnięcia celu przetwarzania oraz (5)przetwarzane w sposób zapewniający odpowiednie bezpieczeństwo danych osobowych, w tym ochronę przed niedozwolonym lub niezgodnym z prawem przetwarzaniem oraz przypadkową utratą, zniszczeniem lub uszkodzeniem, za pomocą odpowiednich środków technicznych lub organizacyjnych.

1.6. 
Uwzględniając charakter, zakres, kontekst i cele przetwarzania oraz ryzyko naruszenia praw lub wolności osób fizycznych o różnym prawdopodobieństwie i wadze zagrożenia, Administrator wdraża odpowiednie środki techniczne i organizacyjne, aby przetwarzanie odbywało się zgodnie z niniejszym rozporządzeniem i aby móc to wykazać. Środki te są w razie potrzeby poddawane przeglądom i uaktualniane. Administrator stosuje środki techniczne zapobiegające pozyskiwaniu i modyfikowaniu przez osoby nieuprawnione, danych osobowych przesyłanych drogą elektroniczną.

1.7. 
Wszelkie słowa, wyrażenia i akronimy występujące w niniejszej polityce prywatności i rozpoczynające się dużą literą (np.Sprzedawca, Sklep Internetowy, Usługa Elektroniczna) należy rozumieć zgodnie z ich definicją zawartą w Regulaminie Sklepu Internetowego dostępnym na stronach Sklepu Internetowego.


2. GROUNDS FOR PROCESSING

2.1. The controller is entitled to process personal data where, and to the extent that, at least one of the following conditions is met: (1) the data subject has given his or her consent to the processing of his or her personal data for one or more specified purposes; (2) the processing is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject prior to entering into a contract;(3) the processing is necessary for compliance with a legal obligation incumbent on the Controller; or (4) processing is necessary for the purposes of legitimate interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

2.2.
The processing of personal data by the Controller requires, in each case, the existence of at least one of the grounds indicated in Point. 2.1 of the Privacy Policy. Specific grounds for processing personal data of the Internet Shop's Users and Customers by the Administrator are indicated in the next point of the privacy policy - with reference to a given purpose of personal data processing by the Administrator.


3. THE PURPOSE, BASIS, DURATION AND SCOPE OF DATA PROCESSING IN THE ONLINE SHOP

3.1. Each time, the purpose, basis, period and scope as well as recipients of personal data processed by the Administrator results from actions taken by a given Customer or Client in the Internet Shop. For example, if the Customer decides to make purchases in the Online Shop and chooses personal collection of the purchased Product instead of courier delivery, his or her personal data will be processed in order to perform the Sales Agreement concluded, but will no longer be made available to the carrier performing the shipment on behalf of the Administrator.

3.2.
The Administrator can process personal data in the Internet Shop for the following purposes, on the following grounds, during the following periods and to the following extent:

 

 

4. THE RECIPIENTS OF THE DATA IN THE ONLINE SHOP

4.1. For the proper functioning of the Internet Shop, including the performance of Sales Agreements concluded, it is necessary for the Administrator to use the services of external entities (such as e.g. software providers, couriers, or payment processors). The controller shall only use the services of such processors that provide sufficient guarantees to implement appropriate technical and organizational measures so that the processing complies with the requirements of the RODO Regulation and protects the rights of data subjects.

4.2.
Personal data may be transferred by the Controller to a third country, whereby the Controller shall ensure that in such a case this will be done in relation to a country ensuring an adequate level of protection - in accordance with the RODO Regulation, and the data subject shall be able to obtain a copy of their data. The Controller shall transfer the collected personal data only in the case and to the extent necessary to carry out the given purpose of data processing in accordance with this Privacy Policy.

4.3.
The transfer of data by the Administrator does not take place in every case and not to all recipients or categories of recipients indicated in the privacy policy - the Administrator transfers data only if it is necessary for the realization of a given purpose of personal data processing and only to the extent necessary for its realization. For example, if the Customer uses personal collection, his/her data will not be transferred to the carrier cooperating with the Administrator.

4.4.
Personal data of Service Recipients and Customers of the Internet Shop may be provided to the following recipients or categories of recipients:
4.4.1.
Carriers / forwarders / cour ier brokers - in the case of a Customer who uses the online store's method of Product delivery by mail or courier, the Administrator makes the collected personal data of the Customer available to the chosen carrier, forwarder or broker executing the shipment on behalf of the Administrator to the extent necessary for the execution of the delivery of the Product to the Customer.
4.4.2.
entities processing electronic or credit card payments - in case of a Customer who uses the electronic or credit card payment method in the Internet Shop, the Administrator shall make the collected personal data of the Customer available to a selected entity processing the aforementioned payments in the Internet Shop on the order of the Administrator to the extent necessary to handle the payment made by the Customer.
4.4.3.
service providers supplying the Administrator with technical, IT and organisational solutions, which enable the Administrator to run his business, including the Internet Shop and the Electronic Services provided by means of it (in particular, suppliers of computer software for running the Internet Shop, electronic mail and hosting providers, services making it possible to automate marketing processes and suppliers of business management software and providing the Administrator with technical assistance) - the Administrator shall make the collected personal data of the Customer available to a chosen supplier acting on his behalf only in the case and to the extent necessary for the accomplishment of a given purpose of data processing in accordance with this Privacy Policy.
4.4.4.
accounting, legal and advisory service providers providing the Administrator with accounting, legal or advisory support (in particular an accounting office, a law firm or a debt collection agency) - the Administrator makes the collected personal data of the Client available to the chosen provider acting on its behalf only in the case and to the extent necessary to realize a given purpose of data processing in accordance with this privacy policy.


5. PROFILING IN AN ONLINE SHOP

5.1. The RODO Regulation imposes an obligation on the Controller to provide information on automated decision-making, including profiling as referred to in Article 22(1) and (4) of the RODO Regulation, and - at least in those cases - relevant information on the modalities of such decision-making, as well as on the significance and the envisaged consequences of such processing for the data subject. With this in mind, the Controller provides information on possible profiling in this section of the privacy policy.

5.2.
The Controller may use profiling in the Internet Shop for direct marketing purposes, but decisions taken on its basis by the Controller shall not concern conclusion or refusal of Sales Agreement or possibility of using Electronic Services in the Internet Shop. The effect of using profiling in the Internet Shop may be e.g. granting a given person a discount, sending him/her a discount code, reminding about unfinished shopping, sending a proposal of a Product, which may correspond to interests or preferences of a given person or offering better conditions in comparison with the standard offer of the Internet Shop. Despite the profiling, it is the person who freely decides whether he wants to use the discount received in this way or better conditions and make a purchase in the Internet Shop.

5.3.
Profiling in the Internet Shop consists in automatic analysis or forecast of a given person's behaviour on the website of the Internet Shop, e.g. through adding a particular Product to the basket, browsing the page of a particular Product in the Internet Shop or through analysis of the previous history of purchases made in the Internet Shop. The condition of such profiling is that the Administrator has the personal data of the given person in order to be able to send him/her e.g. a discount code.

5.4.
The data subject has the right not to be subject to a decision which is based solely on automated processing, including profiling, and which produces legal effects with regard to that person or significantly affects him/her in a similar manner.


6. RIGHTS OF THE DATA SUBJECT

6.1. Right of access, rectification, restriction, erasure or portability - the data subject has the right to demand from the Controller access to his/her personal data, their rectification, erasure ("right to be forgotten") or restriction of processing and has the right to object to the processing, as well as the right to data portability. Detailed conditions for exercising the above-mentioned rights are indicated in Articles 15-21 of the RODO Regulation.

6.2.
Right to withdraw consent at any time - the person whose data are processed by the Administrator on the basis of an expressed consent (pursuant to Article 6(1)(a) or Article 9(2)(a) of the RODO Regulation) has the right to withdraw the consent at any time, without affecting the legality of the processing performed on the basis of the consent prior to its withdrawal.

6.3. Right to lodge a complaint to the supervisory authority - the person whose data are processed by the Controller has the right to lodge a complaint to the supervisory authority in the manner and according to the procedure set out in the provisions of the RODO Regulation and Polish law, in particular the Personal Data Protection Act. The supervisory authority in Poland is the President of the Office for Personal Data Protection.

6.4.
Right to object - the data subject shall have the right to object at any time, on grounds relating to his/her particular situation, to the processing of personal data concerning him/her based on Article 6(1)(e) (public interest or public tasks) or (f) (legitimate interest of the controller), including profiling on the basis of these provisions.The controller shall in that case no longer be permitted to process those personal data unless the controller demonstrates the existence of valid legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or grounds for the establishment, exercise or defence of claims.

6.5.
Right to object to direct marketing - where personal data are processed for the purposes of direct marketing, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, including profiling, to the extent that the processing is related to such direct marketing.

6.6.
In order to exercise the rights referred to in this section of the privacy policy, the Administrator may be contacted by sending a relevant message in writing or by e-mail to the address of the Administrator indicated at the beginning of the privacy policy or by using the contact form available on the website of the Internet Shop.


7. COOKIES IN THE WEBSHOP, USAGE DATA AND ANALYTICS

7.1. Cookies are small information in the form of text files sent by a server and stored on the side of the person visiting the website of the Online Store (e.g. on the hard drive of a computer, laptop or smartphone memory card - depending on the device used by the visitor to our Online Store). 7.2.
The Administrator may process data contained in Cookies when visitors use the website of the Internet Shop for the following purposes:
7.2.1.
7.2.1. identification of Customers as logged in to the Internet Shop and showing that they are logged in;
7.2.2.
memorizing Products added to the basket in order to place an Order;
7.2.3.
7.2.3. remembering data from completed Order Forms, surveys or login data to the Internet Shop;
7.2.4.
7.2.4. adapt the content of the Internet Shop to the individual preferences of the Customer (e.g. concerning colours, font size, page layout) and optimise the use of the Internet Shop pages;
7.2.5.
7.2.5. conduct anonymous statistics presenting the manner of use of the Internet Shop website;
7.2.6.
remarketing, i.e. researching the features of visitors' behaviour in the Internet Shop through anonymous analysis of their actions (e.g. repeated visits to specific pages, keywords etc.) in order to create their profile and provide them with advertisements tailored to their predicted interests, also when they visit other websites in the advertising network of Google Ireland Ltd. and Facebook Ireland Ltd.

7.3.
By default, most web browsers available on the market accept the storage of cookies. You can determine the conditions for the use of cookies through the settings of your web browser. This means that you can, for example, partially restrict (e.g. temporarily) or completely disable the storage of cookies - in the latter case, however, this may affect some of the functionality of the Online Store (for example, it may not be possible to follow the path of the Order through the Order Form due to failure to remember the Products in the basket during the subsequent steps of submitting the Order).

7.4.
Browser settings concerning Cookies are important from the point of view of consent for the use of Cookies by our Online Store - in accordance with the law such consent can also be expressed through the settings of your web browser. If you do not agree to this, you should change your Internet browser's cookie settings accordingly.

7.6. Administrator can use Google Analytics, Universal Analytics provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) and Facebook Pixel service provided by Facebook Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) on the Internet Store. These services help the Administrator to analyse the traffic in the Internet Shop. The collected data is processed within the scope of the above services in an anonymised manner (this is the so-called exploitation data, which prevent identification of a person) to generate statistics helpful in administration of the Internet Shop. This data is collective and anonymous, i.e. it does not contain any identifying characteristics (personal data) of persons visiting the website of the Internet Shop. By using the above services in the Internet Shop the Administrator collects such data as the source and medium of obtaining visitors to the Internet Shop and the manner of their behaviour on the website of the Internet Shop, information about the devices and browsers from which they visit the page, IP and domain, geographical data and demographic data (age, gender) and interests.

8. FINAL PROVISIONS

8.1. The Internet Shop may contain links to other websites. The Administrator encourages to familiarize with the privacy policy of other websites. This privacy policy applies only to the Administrator's Internet Shop.
